These Terms and Conditions set out the basis on which Waste Collection Maida Vale provides waste collection and related services to customers in the United Kingdom. By placing a booking or instructing us to carry out any waste collection, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

1.1 Customer means the individual, business or organisation requesting the waste collection service.

1.2 Services means any waste collection, removal, loading, transportation, sorting or related services provided by us.

1.3 Waste means any items, materials or substances presented by the Customer for removal, including household waste, commercial waste, bulky items and recyclable materials, but excluding prohibited or hazardous waste as set out in these terms.

1.4 Booking means a confirmed request for Services made by the Customer via phone, email, online form or any other method accepted by us.

1.5 Site means the property, premises or location from which the waste is to be collected.

1.6 We, us and our means the waste collection service provider trading as Waste Collection Maida Vale.

2. Scope of Services

2.1 We provide waste collection and related services for domestic and commercial customers within our operational area, including Maida Vale and surrounding districts, subject to capacity and route planning.

2.2 The specific scope of the Services for each Booking, including the type and estimated volume of waste to be collected, will be agreed with the Customer at the time of booking.

2.3 We reserve the right to refuse, suspend or cancel any Service where the waste presented is not as described at the time of booking, is hazardous, or cannot be safely or legally collected.

3. Booking Process

3.1 Bookings can be made by telephone, email or through our online booking channels, where available. The Customer must provide accurate information about the Site, access, parking restrictions, type of waste, estimated volume or weight, and any special requirements.

3.2 All Bookings are subject to acceptance and availability. We will confirm the Booking by providing the Customer with a collection date or time window and an estimated price, where applicable.

3.3 Any estimated price provided ahead of collection is based on the information supplied by the Customer. If, upon arrival, the quantity or type of waste differs materially from the information provided, we may revise the price, adjust the scope of Services, or decline to proceed with all or part of the collection.

3.4 The Customer is responsible for ensuring that a person aged 18 or over is present at the Site at the agreed time of collection, unless we have agreed that waste will be left in an accessible external area for unattended collection.

3.5 We will use reasonable efforts to attend at the agreed time, but any times given for collection are estimates only. We are not liable for minor delays caused by traffic, weather, access issues or other circumstances beyond our reasonable control.

4. Access and Site Conditions

4.1 The Customer must ensure that we have safe, clear and reasonable access to the Site and to the waste to be collected. This includes arranging any necessary parking permissions, permits or authorisations.

4.2 We may refuse to carry out or continue a collection where our staff reasonably consider that access is unsafe, illegal, likely to cause damage, or prevents us from carrying out the Service in a safe and efficient manner.

4.3 The Customer is responsible for obtaining any consents or permissions required from landlords, managing agents, neighbours or local authorities in relation to access, loading and parking at the Site.

4.4 If we are unable to complete a collection due to inadequate access, incorrect address details, or failure of the Customer to provide access at the agreed time, we may charge a wasted journey fee to cover our reasonable costs.

5. Waste Types and Regulations

5.1 We operate in accordance with applicable UK waste legislation and regulations, including the Environmental Protection Act 1990 and the duty of care relating to the handling, transport and disposal of controlled waste.

5.2 The Customer must accurately describe the waste to be collected. We do not accept hazardous or special waste unless expressly agreed in advance and handled under appropriate regulatory controls. Prohibited items can include, but are not limited to, asbestos, clinical waste, toxic substances, chemicals, solvents, explosives, gas bottles, and certain electrical or electronic equipment that requires specialist disposal.

5.3 We may refuse to collect any waste that, in our reasonable opinion, is hazardous, contaminated, improperly packaged, or otherwise unsuitable for standard collection and disposal.

5.4 Once collected, the waste becomes our responsibility and will be transported, treated, recycled or disposed of at licensed facilities, in compliance with applicable laws and regulations. We may separate or sort waste for recycling or recovery where practicable.

5.5 The Customer, as waste producer, remains responsible for ensuring that the waste presented is lawful to dispose of and does not breach any statutory restrictions or third-party rights.

6. Pricing and Payments

6.1 Our charges may be based on a combination of factors, including the type of waste, estimated or actual volume, weight, loading time, and any special handling requirements. Prices will be confirmed at the time of Booking where possible, or otherwise once the waste has been assessed on Site.

6.2 Unless otherwise agreed in writing, payment is due in full on or before completion of the collection. We accept payment methods as communicated to the Customer during the booking process, which may include cash, card or bank transfer.

6.3 For business customers with approved credit accounts, payment terms will be set out in the account approval and on our invoices. If payment is not received by the due date, we may charge interest on overdue amounts at the statutory rate and suspend further Services until all outstanding sums are paid.

6.4 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Where VAT applies, it will be charged at the prevailing rate and shown separately on receipts or invoices.

6.5 If, during the collection, the actual quantity or type of waste materially exceeds that stated at the time of booking, we may adjust the price accordingly. The Customer will be informed of any additional charges before we proceed. If the Customer does not agree to the revised price, we may limit the collection to the level originally quoted or cancel the remainder of the Service.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a Booking by contacting us using the details provided at the time of booking.

7.2 If the Customer cancels a Booking with more than 24 hours notice before the scheduled collection time, no cancellation fee will normally apply.

7.3 If the Customer cancels a Booking with less than 24 hours notice, or fails to provide access at the agreed time, we reserve the right to charge a reasonable cancellation fee or wasted journey fee to cover our costs.

7.4 We may cancel or reschedule a Booking at any time, including on the day of collection, where affected by circumstances outside our reasonable control, such as severe weather, vehicle breakdown, road closures or staff illness. In such cases, we will use reasonable efforts to notify the Customer and rearrange the Service at the earliest mutually convenient time.

7.5 We may cancel a Booking immediately if we reasonably consider that completing the collection would be unsafe, unlawful, or in breach of these Terms and Conditions. In such cases, any prepaid amounts for Services not carried out will be refunded, less any reasonable costs already incurred.

8. Customer Obligations

8.1 The Customer must ensure that the waste to be collected is presented in a manner that allows safe loading, including where required placing items in bags, containers or piles that can be accessed without risk of injury or damage.

8.2 The Customer must not present waste that includes hazardous substances, sharps, or any material which may cause injury or damage during handling, unless this has been expressly agreed and suitable precautions have been arranged.

8.3 The Customer must remove or clearly identify any items not intended for disposal, to prevent accidental removal.

8.4 The Customer warrants that they either own the waste items or have full authority from the owner to arrange their removal and disposal.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. However, we are not liable for any loss or damage arising from inaccurate information provided by the Customer, unsafe access, or failure to comply with these Terms and Conditions.

9.2 While carrying out collections, our staff will take reasonable care to avoid damage to the Site. The Customer acknowledges that certain risks of minor scuffs or marks may arise when removing large or bulky items from confined spaces. We are not liable for minor cosmetic damage that is reasonably incidental to the normal performance of the Services.

9.3 If we cause direct physical damage to property through our negligence, our liability will be limited to the reasonable cost of repair or replacement of the damaged area or item, subject to a fair assessment and any evidence reasonably required.

9.4 We are not liable for any loss of profits, loss of business, loss of data, or any indirect or consequential losses arising out of or in connection with the Services.

9.5 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited or excluded under English law.

10. Insurance

10.1 We maintain appropriate public liability and, where required, employers liability insurance in relation to the provision of waste collection services.

10.2 Evidence of insurance cover may be provided to business customers on reasonable request.

11. Data Protection and Privacy

11.1 We collect and process personal data provided by the Customer for the purposes of managing bookings, providing the Services, handling payments, and maintaining records for legal and regulatory compliance.

11.2 We will handle personal data in accordance with applicable UK data protection laws. We will not sell or share Customer details with third parties for marketing purposes without explicit consent.

11.3 The Customer is responsible for ensuring that any personal data they provide is accurate and up to date.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible with details of the issue so that we can investigate and seek to resolve the matter.

12.2 We will aim to respond to complaints promptly and may request further information or evidence as part of our investigation.

12.3 Where a dispute cannot be resolved directly, the parties may consider mediation or other forms of alternative dispute resolution before commencing court proceedings, although this is not a legal requirement.

13. Variations to Terms

13.1 We may update or revise these Terms and Conditions from time to time. The version in force at the time of the Customer's Booking will apply to that Service, unless otherwise agreed in writing.

13.2 Updated terms may be made available on our standard documentation or upon request.

14. Severability

14.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but this shall not affect the validity and enforceability of the remaining provisions.

15. Entire Agreement

15.1 These Terms and Conditions, together with any written quotation or confirmation issued by us, constitute the entire agreement between the parties in relation to the Services and supersede any previous understandings or arrangements, whether oral or written.

15.2 The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By placing a booking or allowing our team to commence a waste collection, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
